Any information collected on this website or during any project, will remain strictly private and will never be shared with a third party. We absolutely understand and value your privacy.

Terms and Conditions

The following Terms and Conditions apply to all services provided by Toribella Web Design. Throughout our Policies and Terms, Toribella Web Design will be referred to as "TWD", and any customer or client will be referred to as "Client".

A. All services provided by TWD, will be provided with the understanding that the client has read, understands and agrees to all Terms and Conditions. TWD reserves the right to make changes to our Terms and Conditions at any time, and will post a notice on our site of such changes at that time.

B. After a quote request has been sent to TWD, the client will be sent a confidential quote via email, within 1-3 days. This quote will provide the client with any costs for the services requested. All quotes are valid for 10 days only, unless a deposit has been made, and are subject to change should the project change, or if more resources are necessary to complete the project than originally anticipated. The client will be notified if any changes need to be made to the quote.

C. The quote that is given by TWD will determine any required fees and costs that must be paid before any work is to begin. The quote given by TWD is only for the services that were requested previously by the client when filling out the design quote form. The acceptance of the service quote will be confirmed by payment of any deposit fees agreed upon, as well as the acceptance of TWD's Terms and Conditions. Once payment has been received, the contract to complete the project will at that time commence. If the required payment has not been made within 10 days from quote acceptance, the quote will thrown out at that time. Should the client wish to continue with the project, a new quote will be given. TWD sometimes accepts work on a "First come, first serve" basis for our waiting list, and in order to confirm your spot on this list, a non-refundable deposit of 25% of the quoted amount is requested and should be paid immediately in order to secure your placement for the quoted price.

D. Once the quote has been accepted and a security deposit has been made, TWD will submit a questionnaire to the client via email, which contains the information needed in the form of an outline, for the start and completion of the project. This project outline will need to be submitted back to TWD within 10 days from the time of delivery. If outline has not been received by TWD within a timely manner (15 days or less), additional charges may apply at the descretion of TWD.

E. Once the project outline has been submitted back to TWD via email, such information will be considered the final word on what is expected of TWD for the full completion of the project. Additional charges may apply if any additional information should be added to the outline at a later date for further project tasks. TWD reserves the right to decline any requested changes that are outside of the original outline provided by the client and that are outside of the information given for the original quote provided by TWD.

F. TWD will make all reasonable efforts to ensure that the project is completed by the agreed upon time frame. Such agreed upon time frame should be used as an estimated or targeted time for delivery only, and should not be taken as a literal or guaranteed actual completion date. Any time frame originally given will be based on the information submitted via the quote request form, and does not account for any extra services or work that is required thereafter. The client agrees not to hold TWD liable for any project delays, or losses associated with these delays.

G. During the project's design process, it is required that the client work with TWD, in order to reach the goal of completing the project. This includes answering emails in a timely manner (within 24 hours per email) for questions that TWD has along the way, as well as providing feedback on design drafts. If responses to TWD's emails are not made within a timely manner, the client may incure additional charges, and if a significant amount of time has passed (7 days) without hearing from the client regarding important information, the clients project shall be placed on hold and will need to be put on a waiting list until TWD has a new opening for completing the project. Once the project has resumed after being placed on hold, the final payment must be paid before the remaining amount of work is to begin.

H.Any discarded designs, ideas or drafts shall remain the sole property of TWD and may not be used by the client for any purpose, unless purchased separately.

I. Once a final design draft has been agreed upon by the client, TWD will require all final payments in full, before the final code and graphics will be uploaded to the client's hosted website. The web design project will be considered complete, when tasks in the client-submitted project outline have been addressed and fullfilled by TWD. At this time, any further requests for work or mainenance will be an additional charge.

J. If any errors or "bugs" happen to occur in our ecommerce software, TWD agrees to fix these errors at no cost for up to 6 months after the date of website completion, only under the terms that a.) The website and/or software has not been modified by any third parties, b.) the website is not hosted by a third party, c.) the error or bug has not been caused by the client either directly or indirectly. If any of the previous statements are false, then we will fix any technical issues and such fixes will be billed at our current hourly maintenance rate of $35 per hour.

K. Any website changes in the form of design, site functionality, upgrades, site enhancements or content changes, that are requested by the client, after the completion of the project, are considered "maintenance". Maintenance rates are currently $35 per hour and will apply to any work carried out by TWD. Maintenance is only available for websites that have been completed by TWD.

L. A basic working knowledge of computers, email, and internet is essential in order to operate and update a website. TWD provides clients with manuals and information pertaining to any software that is provided by TWD. Support for software not provided by TWD, should be directed towards the owner of the software. Unless otherwise stated in your quote, training of software is not included in your quote. If training should be required for more than 15 minutes, an hourly rate of $35 will apply. This includes email, chat or phone support.

M. It is required that a text remain at the bottom of the site linking back to TWD at all times, unless a copyright removal has been purchased.

N. TWD reserves the right to refuse work to any person, without giving reason, and will not include in its designs any material which might be considered immoral, offensive, obscene or illegal.
